Anna Yakovleva and Ekaterina Belyaeva attended as speakers a SPIBA Legal Discussion Club meeting on court practice on disputes over the recognition of objects as immovable property
A Legal Discussion Club meeting was held on June 28, 2018 at St. Petersburg International Business Association (SPIBA) to debate the curious decisions rendered by Russian courts to settle disputes related to real estate. Anna Yakovleva, Senior Associate at Forte Tax & Law, SPIBA Legal Committee co-chairman, and Ekaterina Belyaeva, Junior Associate at Forte Tax & Law, were speakers at this meeting.
Anna and Ekaterina discussed at this meeting the court decisions rendered by the Supreme and High Commercial Courts of Russia as well as the criteria they use to qualify as immovable property objects that are not obviously so such as, for example, inexpensive structures, green spaces, prefabricated structures, and sea vessels fitted as restaurants. After this discussion, the meeting attendees concluded that no definite criteria have been set to qualify objects as immovable property, and the “horizontal” split between land plot and property on land plot only complicates the qualification of immovable property further.
