The Zakon Magazine Publishes Article by Anton Kabakov on Inclusion of Dividends in Customs Value

The November issue of the Zakon magazine has published an article by Anton Kabakov, Partner at Forte Tax & Law, on a most topical issue—the inclusion of dividends in the customs value.

This article aims to shed light on an intersection of transfer pricing and customs valuation when it comes to dividends. In particular, the article explores:

• Whether dividends are to be included in the customs value under the transaction value method;
• The difference in approaches to the inclusion of dividends in the customs value in the Customs Code of the Eurasian Economic Union (EAEU) and the WTO Agreement on Implementation of Article VII of the General Agreement on Tariffs and Trade 1994;
• Judicial practice on the inclusion of dividends in the customs value; and
• Using transfer pricing documentation to justify that there is no need to include dividends in the customs value of imported goods under the transaction value method.
