How to work on public holidays in May 2021?
In addition to the already well-known Presidential Decree on non-working days in May 2021, the Ministry of Labor has issued its recommendations on the application of this decree in practice.
Main conclusions:
- Organizations/employers determine themselves the number and which employees will work from May 04 to May 07, including those working remotely.
- If an organization decides that its employees are to work during that period, the organization must document such decision by issuing an order (e.g. CEO Order). We recommend indicating briefly in such document that employees are to work to ensure the running of the organization.
- Employees working from May 4 to May 7, 2021 will be paid as usual with no increased pay although employers may on their own decide whether they pay their employees more for working during that period.
- Employees who will not work from May 4 to May 7, 2021 will be paid for those days the same as if they had worked these non-working days.
- Employees who are paid on a piece-rate basis will be paid for these non-working days the appropriate amount as set out in the employer’s internal regulations.
- Employees working from May 1 to May 3 and from May 8 to May 10, 2021 are to be paid according to the rules for weekends and public holidays (i.e. double).
- If an employee is on vacation from May 4 to May 7, 2021, the vacation will not be extended by the non-working days set out by the Decree.
