Anton Kabakov talked to Kommersant about director and company officer liability

Last week, Kommersant published an article about the problematic legal regulation of director and company officer liability which is a challenging issue in modern-day Russia.

Anton Kabakov, partner at Forte Tax & Law, shared his opinion on this topic in an interview with Kommersant.

“There has been a clear propensity in Russia since 2013 to bring directors and company officers to liability for their decisions, and this trend has only gained momentum in subsequent years”, commented Anton.

Anton also noted that recent Supreme Court rulings have paved the way to impose secondary liability not only on company directors but also on their legal successors. It has also become possible to compel directors to compensate for losses even if they followed the shareholders’ instructions.
